In no event shall XE be liable for indirect, special, punitive, or consequential damages including, but not limited to, lost profits, lost data, or otherwise. In no event shall XE's aggregate liability hereunder, whether arising in contract, tort, strict liability, or otherwise, exceed the amount of fees (consisting of the Initial License Fee and any applicable Renewal License Fee) paid by You annually hereunder for the license of XE Datafeed.

You acknowledge that XE is not, and is not affiliated with, a financial institution or financial data feed provider, but obtains its financial data (including, but not limited to, Raw Currency Data and Other Data) from a variety of sources.
